Event Ticket Terms & Conditions

1.      These terms

  • Scope of these terms. These terms and conditions govern the supply of Event Tickets to you when you make a purchase online through our membership portal at https://igauk.justgo.com/ or via our Eventbrite page at https://www.eventbrite.co.uk/o/independent-gymnastics-38983103833.
  • Importance of reading these terms. We kindly ask you to carefully read these terms before placing your order with us. These terms provide information about our identity, how we will deliver Event Tickets to you, the procedures for making changes or terminating the contract, what to do in case of any issues, and other significant details. If you believe that there is an error in these terms, please contact us for further discussion.

 

2.      Information about us and how to contact us.

  • Our identity. We are Independent Gymnastics Affiliation Limited, a privately held company registered in England and Wales under company number 10865718. Our registered office is located at Unit 6, Edison Business Centre, 52 Edison Road, Rabans Lane Industrial Area, Aylesbury, Buckinghamshire, England, HP19 8TE.
  • How to reach us. You can contact us via email at info@igauk.com.
  • Our means of communication. If we need to get in touch with you, we will do so by telephone or by sending written communication to the email address or postal address you provided during the ordering process.
  • Inclusion of emails in “writing”. In these terms, the terms “writing” or “written” also include communication sent via email.

 

3.      Definitions and Abbreviations

Independent GymnasticsRefers to IGA. When using the terms “we,” “us,” or “our,” it pertains to IGA.
EventAny planned, organised, hosted, or run event by Independent Gymnastics.
Spectator Ticket(s):Refers to one or more tickets sold online for any event organised by Independent Gymnastics where spectators are present.
Coaching Course Ticket(s)Refers to one or more spaces sold online for any coaching course organised by Independent Gymnastics.
Competition EntryRefers to one of more spaces sold online for competitions organised by IGA.
Event Ticket(s):Refers to one or more tickets sold online for any event organised by Independent Gymnastics.
Force Majeure Event:Any circumstance beyond a party’s reasonable control, including but not limited to:

•         Acts of God, such as flood, drought, earthquake, or other natural disaster.

•         Epidemic or pandemic.

•         Terrorist attack, civil war, civil commotion, riots, war, threat of war, armed conflict, imposition of sanctions, embargo, or breaking off diplomatic relations.

•         Nuclear, chemical, or biological contamination or sonic boom.

•         Any law or action taken by a government or public authority, including restrictions, quotas, or prohibitions on export or import.

•         Collapse of buildings, fire, explosion, or accident.

•         Interruption or failure of utility service; or

•         Withdrawal of permission to hold the event by the entity operating the venue.

VenueThe location or address where a specific event is being held. The venue may vary for each event, and details will be provided prior to the order and specified on the event ticket.

 

4.      Our contract with you

  • Acceptance of your order. We will accept your order and form a contract between you and Independent Gymnastics when we provide written confirmation of acceptance.
  • Inability to accept your order. If we are unable to accept your order, we will notify you in writing, particularly for online Event Ticket purchases. This may be due to tickets being sold out, unforeseen resource limitations, or errors in the price or description of the tickets.
  • Order reference number. For online Event Ticket purchases, we will assign a unique reference number to your order and communicate it to you upon acceptance. Please provide this order number whenever you contact us regarding your order. This order number will differ from the ticket number and will be specified in the confirmation email.
  • UK sales only. Our website is intended for the promotion of our services within the United Kingdom. Unfortunately, we do not accept orders from addresses outside of this geographical area.

 

5.      Your rights to make changes.

  • Refunds and exchanges for Spectator Tickets. Except in the case of a Force Majeure Event, Spectator Tickets are non-refundable, non-returnable, and non-exchangeable.
  • Rights for Coaching Course Ticket(s).
    • Cancellation and refund. You have the right to cancel your space(s) and receive a refund up to 15 days prior to the course start date. If you wish to cancel, you must submit a written request, including copies of any relevant receipts and reference numbers associated with your booking.
    • No refund for non-attendance. We cannot provide a refund for your space(s) if you do not attend or arrive late. Please note that those booked on to a coaching course who arrive more than 30 minutes past the scheduled start time may not be admitted, and no refund will be issued.
  • Rights for Competition entry.
    • Cancellation and refund. You have the right to withdraw from competitions prior to the “official closing date” where entry fees will be refunded. Withdrawals received after the “official closing date” will only be refunded when a doctor’s note is provided. Otherwise, entry fees are non-refundable.
    • No refund for non-attendance. No refund for non-attendance. We cannot provide a refund for your space(s) if you do not attend or arrive late.

 

 

6.      Our rights to make changes.

  • Minor changes to the services. Independent Gymnastics reserves the right to make minor changes to the services in the following circumstances:
    • to comply with relevant laws and regulatory requirements.
    • to implement minor technical adjustments and improvements, such as addressing security threats. These changes will not significantly affect the service you receive.
    • to modify the type or quantity of sessions.
    • to adjust start and finish times.
    • to change the Venue location within a reasonable distance; and
    • to substitute gymnasts or other participants due to injury or availability. Please note that any pictures used in the marketing of the tickets are not indicative of the gymnasts who will be participating in the event.
  • More significant changes to the services and these terms. While every effort is made to ensure the accuracy of information at the time of publication, Independent Gymnastics reserves the right to make significant changes to Events when necessary. In the event of major changes to an Event (including those listed below), you will be entitled to a full refund:
    • changes to the date of the Event, including event cancellation.
    • changes to pricing related to an Event; and
    • changes to the Venue of the Event, except for changes within a reasonable distance of the original venue.

 

7.      Providing the services

  • Delivery of Event Tickets. During the order process, we will inform you of the availability of the Event Tickets.
    • Online purchase of Event Tickets. If you purchase Event Tickets online, they will be emailed to you upon completion of the payment. Event Tickets will not be physically mailed and will only be provided electronically. Event Tickets will be available for online purchase throughout the event.
  • Presentation of Event Tickets. Please ensure that you present your Event Ticket at the Event to gain access. You can present either a printed ticket or an electronic version on a device. If you choose to use an electronic version, make sure your device has sufficient charge to allow inspection of your ticket at any time during the event. Failure to produce a valid Event Ticket may result in the need to purchase a new ticket or denial of entry to the Event.
  • Ownership of Event Tickets. You assume ownership of the Event Tickets upon full payment. Once you own the Event Tickets, you are responsible for their safekeeping. Independent Gymnastics is not liable for any lost, stolen, or destroyed Event Tickets, and they cannot be replaced. We recommend checking your Event Ticket upon receipt as errors may not always be rectified. If you notice a mistake, please contact us.
  • Entry conditions for the Event. Admission to the Event and Venue is subject to the terms and conditions of Independent Gymnastics and the Venue. You must comply with all health, safety, and security requirements outlined in these terms and conditions and those of the Venue. With the exception of assistance dogs, dogs are not permitted at any Event. Unless otherwise specified, tickets are for general admission and do not guarantee a specific seat. Children under the age of 16 must be accompanied by an adult. By attending the Event, you consent to being filmed and recorded as part of the audience.   • Failure to provide required information. We may require specific information from you to supply the Event Tickets, such as an email address for electronic tickets. If this information is not provided within your order or is incomplete or incorrect, we may either terminate the contract (see clause 9.1) or charge an additional reasonable sum to compensate for any additional work required. We will not be responsible for late delivery or non-delivery of the Event Tickets if it is caused by your failure to provide the necessary information within a reasonable timeframe.
  • Cancellation or postponement of services. We may cancel or postpone the supply of Event Tickets in the following circumstances:
    • Technical problems or minor technical changes.
    • Updates to reflect changes in relevant laws and regulatory requirements.
  • Your rights in the event of cancellation or postponement. Independent Gymnastics will make reasonable efforts to notify you in advance of any cancellation or postponement of an Event, unless it is urgent or an emergency situation. However, we cannot guarantee prior notification before the Event date. If an Event is cancelled or postponed, or we inform you of the cancellation or postponement, you may choose to end the contract for the Event Tickets and receive a refund of any pre-paid sums.
  • Cancellation or postponement due to non-payment. If you fail to make payment for the services as required (see clause 4) and do not pay within 7 days of our reminder or prior to the Event (whichever is sooner), we may suspend the supply of services or cancel the Event Tickets until the outstanding amounts are paid. We will inform you of the suspension of services. No charges will be incurred for the services during the period of postponement.

 

8.      Your rights to end the contract.

  • Termination of the contract for a valid reason. If you have a valid reason as outlined in (a) to (e) below, you may terminate the contract immediately and receive a full refund for any Event Tickets that have not been provided or have not been provided correctly. Valid reasons for termination are as follows:
    • Independent Gymnastics has notified you of an upcoming change to the Event or these terms, and you do not agree to the change (see clause 6.2).
    • We have notified you of an error in the price or description of the Event Ticket you ordered, and you choose not to proceed.
    • There is a significant risk of substantial delay to the Event due to external factors beyond our control.
    • Independent Gymnastics has postponed the Event for technical reasons or has informed you of the intention to postpone the Event for technical reasons; or
    • You have a legal right to terminate the contract due to our wrongdoing.
  • No right to terminate in certain cases. You do not have the right to terminate the contract if you have purchased an Event Ticket for a specific date or time and none of the scenarios outlined in clause 8.1 apply.
  • Right to change your mind (Consumer Contracts Regulations 2013). If you have purchased a ticket without a specific date listed, you are entitled to exercise your legal right to change your mind within 14 days and receive a refund. These rights are governed by the Consumer Contracts Regulations 2013.

 

9.      Our rights to end the contract.

  • Termination due to breach. Independent Gymnastics reserves the right to refuse your admission or eject you from an Event if, during the Event:
    • You pose a threat to children.
    • You create safeguarding or welfare issues.
    • You engage in abusive, threatening, drunken, or other anti-social behaviour.
    • You carry offensive weapons or illegal or prohibited substances.
    • You film or record, for public purposes, without the express permission of the Independent Gymnastics Media Team.     • You bring, distribute, or display sponsorship, promotional or marketing propaganda, or offensive, defamatory, or religious materials.
    • You persist in using air horns, rattles, or other devices after they have been deemed unsafe for the performing gymnasts.
    • You fail to produce a valid Event Ticket for which you have paid. For example, if the ticket you initially purchased is void due to a request for an exchange to a different date, rendering the original ticket invalid.
    • You breach any of these Terms, such as failure to pay for tickets at the time of purchase and prior to the Event taking place.
    • You bring unauthorised food or drink into the Venue; or
    • Any other circumstances arise in which the Venue or Independent Gymnastics reasonably believe there is a legitimate reason to refuse your admission or eject you.
  • If you are refused entry or ejected from an Event for any of the above reasons, no refunds or compensation will be provided. Independent Gymnastics reserves the right, at their reasonable discretion, to prevent your entry to future events or eject you from future events.
  • Compensation for breach of contract. If Independent Gymnastics ends the contract under the circumstances outlined in clause 9.1, you may be required to compensate them for the net costs incurred as a result of your breach of contract.
  • Event cancellation. Independent Gymnastics may inform you in writing of the cancellation of an Event. Reasonable efforts will be made to notify you in advance. In the event of cancellation, any pre-paid sums for the Event will be refunded. If you attend an Event without an Event Ticket or with an invalid ticket, Independent Gymnastics reserves the right to deny entry or eject you from the Event. the intention of buying one and the Event is cancelled, you have no right to any compensation.

 

10. If there is a problem with the online booking system

  • How to report issues. If you encounter any difficulties or have any questions or complaints regarding the online booking process for Event Tickets, please contact us. You can reach us via email at info@igauk.com. Alternatively, you can speak to one of our staff members at the Event.
  • Summary of your legal rights. We have a legal obligation to provide services that comply with this contract. The following is a summary of your key legal rights concerning the services. Your legal rights are not affected by these terms. Please refer to the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06 for detailed information.

 

Under the Consumer Rights Act 2015, regarding the provision of services:

  • You have the right to request a repeat of the service, or have it fixed if it was not carried out with reasonable care and skill. If the issue cannot be resolved, you may be entitled to a refund.
  • If no price was agreed upon beforehand, the amount you are asked to pay must be reasonable.
  • If no specific timeframe was agreed upon beforehand, the service must be provided within a reasonable time.

 

11. Price and payment

  • Finding the price for the Event Ticket. The price of the Event Ticket, including VAT, will be the price stated in the current price list at the time of your order, unless we have agreed on a different price in writing or orally. We make every effort to ensure the accuracy of the price of the Event Ticket. However, please refer to clause 11.3 for what happens if we discover an error in the price of the Event Ticket you ordered.
  • Changes in VAT rate. If the rate of VAT changes between the date of your order and the date of the Event, we will adjust the VAT rate accordingly, unless you have already made full payment for the Event Ticket before the change takes effect.
  • Price errors. Despite our best efforts, there is a possibility that some Event Tickets may be incorrectly priced. We typically verify prices before accepting an order. If the correct price of the Event Ticket is lower than the stated price at the time of your order, we will charge you the lower amount. If the correct price of the Event Ticket is higher than the price stated in our price list, we will contact you for further instructions before accepting your order. In cases where a pricing error is obvious and should have been recognised by you as a mispricing, we may end the contract and refund any amount you have paid.
  • Payment terms. Payment must be made according to our standard terms and conditions, which can be found at: https://www.independentgymnastics.com/terms-conditions/. The payment terms depend on how you place your order:
    • Online: You must make a 100% advance payment of the Event Ticket price before we provide the tickets.

 

12. Resale of Event Tickets

  • Prohibition of ticket resale. Reselling Event Tickets at a higher price than the original sale price is not permitted.
  • Consent for ticket resale. If you intend to sell your Event Ticket, you must obtain express written consent from Independent Gymnastics.

 

13. Our responsibility for loss or damage suffered by you.

  • Our responsibility for foreseeable loss and damage. We are responsible for foreseeable loss and damage caused by our breach of these terms or our failure to exercise reasonable care and skill. However, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious or if, at the time the contract was made, both parties knew it could happen (for example, if it was discussed during the sales process).
  • No exclusion or limitation of liability. We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors; liability for fraud or fraudulent misrepresentation; and liability for breach of your legal rights in relation to the services as summarised in clause 10.2.
  • Exclusion of additional costs. We are not responsible for any additional costs incurred as a result of Event cancellation or postponement. In such cases, we will only refund the price paid for the Event Ticket.
  • Your responsibility for loss or damage caused. We are not responsible for any loss or damage caused by you, including the cost of replacement or repair.

 

14. Use of your personal information

15. Other important terms

  • Transfer of the Agreement. We have the right to transfer our rights and obligations under these terms to another organisation. If we decide to do so, we will notify you in advance. If you are not satisfied with the transfer, you may contact us to terminate the contract within a reasonable period, and we will refund any advance payments you have made for Events that have not yet taken place.
  • Transfer of your rights. You may only transfer your rights or obligations under these terms to another person with our written consent. We may require the person to whom the transfer is made to provide reasonable evidence of their ownership, such as legal proof of the transfer.
  • Rights of third parties. This contract is solely between you and us. No other person shall have any rights to enforce any of its terms, unless explicitly stated otherwise.
  • If any court or relevant authority finds any part of this contract to be unlawful, the remaining parts will remain in full force and effect.
  • Delay in enforcing the contract. If we fail to insist immediately that you fulfil any obligations under these terms, or if we delay in taking action against you for your breach of this contract, it does not mean that you are exempt from fulfilling those obligations, nor does it prevent us from taking action against you at a later date. For example, if you miss a payment and we do not pursue it immediately but continue to provide the services, we can still require you to make the payment at a later date.
  • Applicable law and jurisdiction. These terms are governed by the laws of England and Wales, and any legal proceedings brought by either party shall be exclusively subject to the jurisdiction of the courts of England and Wales.
